1Acceptance of these terms#

These Terms and Conditions ("Terms") govern your access to and use of this website and any purchase made through it. The website is owned and operated by Biteora Foods LLP ("Biteora", "we", "us" or "our"), having its principal place of business at A-83, Second Floor, A-Block, Sector-83, Noida, Gautam Buddha Nagar, Uttar Pradesh, 201305.

By accessing, browsing or otherwise using this website, or by placing an order through it, you acknowledge that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, Return and Refund Policy and Shipping and Delivery Policy, each of which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not use this website.

2About us#

3FSSAI licensing and food safety compliance#

We are a Food Business Operator within the meaning of the Food Safety and Standards Act, 2006 and the regulations made under it, and we sell food through an e-commerce channel. We are required to hold, display and operate under a valid licence issued by the Food Safety and Standards Authority of India ("FSSAI").

We undertake that:

• all products offered on this website are manufactured, packed, stored and handled in accordance with the Food Safety and Standards Act, 2006 and the regulations made under it;
• the mandatory declarations required by the Food Safety and Standards (Labelling and Display) Regulations, 2020 — including the list of ingredients, nutritional information, allergen declarations, the vegetarian or non-vegetarian symbol, net quantity, batch number, date of manufacture and "best before" date — appear on the pack you receive;
• we will not deliver any product whose remaining shelf life at the time of delivery is less than the minimum prescribed by FSSAI for e-commerce food business operators; and
• the product delivered to you will correspond to the description, images and information displayed on this website.

4Food Safety Connect — reporting a concern#

Consumer safety is not something we treat as a formality. If you have any concern about the safety, quality, labelling or condition of a Biteora product, we ask you to tell us first at info.biteorafoods@gmail.com so that we can investigate and act quickly.

You are also entitled, at any time, to report a food safety concern directly to the regulator through the FSSAI Food Safety Connect mobile application, available for Android and iOS, or through the FSSAI online grievance portal. The application allows any consumer to lodge a complaint about a food product or a food business operator, to attach photographs, and to track the status of that complaint. We fully support this mechanism and will cooperate with any resulting enquiry.

5Product information, images and claims#

We take care to describe our products accurately. Photographs and illustrations on this website are for representation; packaging, garnish and styling shown may differ from the product as delivered. Natural agricultural produce varies in size, colour and texture between batches, and such variation is not a defect.

Nutritional values stated on this website are typical values and are subject to the tolerances permitted under applicable food regulations. Where we make any nutrition or comparative claim, that claim relates to the product as sold and is made in accordance with the Food Safety and Standards (Advertising and Claims) Regulations, 2018. The information on this website is provided for general information and is not medical or dietary advice. If you have a food allergy, an intolerance, or a medical condition, please read the pack label carefully and consult a qualified professional before consuming.

6Eligibility#

You may use this website and place orders only if you are at least 18 years of age and legally competent to enter into a contract under the Indian Contract Act, 1872. If you are below 18, you may use this website only with the involvement of a parent or lawful guardian. By placing an order, you represent that you meet these requirements and that the information you provide is true, accurate and complete.

7Acceptable use of this website#

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of this website by, any other person. In particular, you must not:

• use the website in violation of any applicable Indian law or regulation;
• place fraudulent, speculative or false orders, or use a payment instrument you are not authorised to use;
• impersonate any person, or misrepresent your identity or affiliation;
• attempt to gain unauthorised access to any part of the website, its servers, or any connected system or network;
• introduce any virus, worm, malware or other harmful code, or attempt to interfere with, disable or overload the website;
• use any automated system — including any robot, spider, scraper or data-mining tool — to access, monitor or copy the website or its content, except for search engine crawlers operating in accordance with our published instructions;
• resell, redistribute or commercially exploit our products or content without our prior written consent;
• copy, reproduce, republish, reverse engineer or create derivative works from any part of this website; or
• post or transmit any content that is unlawful, defamatory, obscene, misleading, or that infringes the intellectual property or privacy rights of any person.

We reserve the right to suspend or terminate access, to cancel any order, and to take appropriate legal action where we reasonably believe these Terms have been breached.

8Orders, pricing and payment#

All prices are displayed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise. Delivery charges, where applicable, are shown separately at checkout before you confirm payment, in accordance with our Shipping and Delivery Policy.

Your order constitutes an offer to purchase. A contract is formed only when we confirm dispatch of that order. We reserve the right to decline or cancel any order — including after a confirmation email — in cases of a manifest pricing or description error, unavailability of stock, suspected fraud, or an inability to deliver to the address provided. Where we cancel a paid order for any such reason, we refund the full amount under our Return and Refund Policy.

We may change prices, product offerings and promotional terms at any time. Such changes do not affect orders already confirmed for dispatch.

9Delivery, returns and refunds#

Delivery timelines, shipping charges and the treatment of lost, delayed and undeliverable parcels are governed by our Shipping and Delivery Policy. Cancellations, returns, replacements and refunds are governed by our Return and Refund Policy, which records that opened food products are non-returnable for reasons of hygiene and food safety.

10Intellectual property#

The Biteora name, logo, packaging design, product photography, illustrations, copy, and the design and arrangement of this website are the intellectual property of Biteora Foods LLP or its licensors, and are protected under the Trade Marks Act, 1999, the Copyright Act, 1957 and other applicable laws. Nothing on this website grants you any licence or right to use them. You may not use our marks or content without our prior written permission.

11Third-party links and services#

This website may link to, or rely on, third-party services such as payment gateways, courier tracking pages and social media platforms. We do not control those services and are not responsible for their content, their availability, or their privacy and security practices. Your use of a third-party service is governed by that party’s own terms.

12Disclaimers and limitation of liability#

This website and its content are provided on an "as is" and "as available" basis. While we take reasonable care to keep the website accurate, secure and available, we do not warrant that it will be uninterrupted, error-free, or free of harmful components.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded — including our obligations as a Food Business Operator and your rights under the Consumer Protection Act, 2019.

Subject to the preceding paragraph, and to the maximum extent permitted by law, our aggregate liability arising out of or in connection with any order shall not exceed the total amount paid by you for that order. We shall not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, goodwill or opportunity.

We are not liable for any failure or delay in performing our obligations where that failure or delay results from an event beyond our reasonable control, including acts of God, flood, fire, epidemic or pandemic, strike, civil unrest, failure of transport or telecommunications networks, or governmental action.

13Indemnity#

You agree to indemnify and hold harmless Biteora Foods LLP, its partners, employees and agents from and against any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of any applicable law, or your infringement of the rights of any third party.

14Governing law and jurisdiction#

These Terms, and any dispute or claim arising out of or in connection with them, their subject matter or their formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of India.

The courts at Noida, Gautam Buddha Nagar, Uttar Pradesh shall have exclusive jurisdiction over any such dispute or claim, and you and we submit to the exclusive jurisdiction of those courts.

This clause does not deprive you of the right to approach a consumer forum having jurisdiction under the Consumer Protection Act, 2019.

15Severability, waiver and changes#

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force. Our failure to enforce any right or provision shall not constitute a waiver of it.

We may amend these Terms from time to time. The amended Terms take effect when published on this page with a revised "last updated" date, and your continued use of the website after that date constitutes acceptance. We encourage you to review this page periodically.

16Grievance redressal#

In accordance with the Consumer Protection (E-Commerce) Rules, 2020, we operate a grievance redressal mechanism. If something has gone wrong with your order, or you are unhappy with how a request was handled, this is the route to escalate it.

We acknowledge every complaint within 48 hours of receipt and endeavour to resolve it within one month, as required under the said Rules. Please quote your order number and describe the issue so we can help you faster.
